Legislator and senior CPI(M) leader, Muhammad Yousuf  Tarigami Friday submitted a Private Member’s Bill to the J&K legislative Assembly Secretariat seeking repeal of Section 298-A, 298-B, 298-C and 298-D of Ranbir Penal Code (RPC).In his statement of objects and reasons, Tarigami has said that the Constitution of India and the constitution of Jammu and Kashmir provides for freedom of conscience and free profession, practice of religion to every citizen of the country/state subject.Section 298-A, 298-B, 298-C and 298-D of Ranbir Penal Code under the classification of offences relating to religion, violates the constitutional guaranteed fundamental rights of the personal life, freedom and liberty of the citizens of Jammu and Kashmir state and amounts to the unwarranted interference to the inalienable rights of the state subject, moreover, is not constitutionally valid piece of legislation. The present ‘Bill’ seeks to delete Section 298-A, 298-B, 298-C and 298-D of State’s Ranbir Penal Code, Samvat, 1989 and corresponding provision of Code of Criminal Procedure Samvat, 1989, as it is de-hors and violative of the basic structure of the Constitution and doesn’t qualify the ingredients of constitutionally valid law.
