Advocate and legal analyst Advocate Hemant Kumar from the Punjab and Haryana High Court discussed the subject of Naib Singh Saini, the MP from Kurukshetra, becoming the next Chief Minister of Haryana. He explained that since Naib Saini is currently not a member of the Haryana Legislative Assembly, he can remain in the position of Chief Minister for a maximum of six months, until September 11, 2024, without being an MLA.
Referencing Article 164(4) of the Constitution of India, Hemant stated that it clearly mentions that a minister (Chief Minister) who is not a continuous member of the state's legislative assembly for six months ceases to be a minister after the end of that period. He further noted that the current 14th Haryana Legislative Assembly completed four years of its term on November 3, 2023.
The first session of the state's legislative assembly was convened on November 4, 2019. According to Article 172 of the Constitution, each state's legislative assembly, unless dissolved earlier, continues for five years from the date appointed for its first session, and not any longer, after which it automatically dissolves.
However, the term of the current 14th Haryana Legislative Assembly ends on November 3, 2024, although it could be dissolved earlier. The state cabinet, chaired by the Chief Minister, has the authority to make this decision, which upon the Governor's approval, results in the dissolution of the assembly before the end of the stipulated five-year period.
Hemant further explained that after November 3, 2023, if a legislative assembly seat becomes vacant due to the death, resignation, or disqualification of an existing MLA and is declared vacant, the Election Commission cannot hold a by-election for that vacant seat.
Since the remaining term of such a preceding MLA after November 3, 2023, would be less than one year, under Section 151(A) of the Representation of the People Act, 1951, a by-election is not conducted for any seat where the remaining term of the predecessor MLA is less than one year.
Hemant mentioned a loophole stating that if someone is appointed as the Chief Minister or Minister of the state, like Naib Saini has been appointed as the Chief Minister of Haryana and is not a current member of the Haryana Legislative Assembly, then a by-election can be conducted for a duly vacated legislative assembly seat during the last year of the assembly's term.
He cited the example from 1986 when Bansi Lal became the Chief Minister of Haryana and won a by-election from the Tosham constituency of Bhiwani district despite the remaining term of the then Haryana Legislative Assembly being less than a year. Hemant mentioned that as of today, there is no vacant seat in the current 14th Haryana Legislative Assembly.
Therefore, a by-election can only be conducted within the next six months if an existing MLA resigns from their seat, which is highly unlikely. In such a scenario, i.e., if Naib Singh Saini cannot become an MLA within the next six months, i.e., before September 11, 2024, he will have to dissolve the current 14th Haryana Legislative Assembly ahead of time, i.e., before November 3, 2024, to enable the next general elections for the legislative assembly.

कुरुक्षेत्र से लोकसभा सांसद नायब सिंह सैनी के हरियाणा का अगला मुख्यमंत्री बनने के विषय पर पंजाब एवं हरियाणा हाईकोर्ट के एडवोकेट और कानूनी विश्लेषक हेमंत कुमार ने बताया कि चूँकि वर्तमान में नायब सैनी हरियाणा विधानसभा के सदस्य अर्थात विधायक नहीं है, इसलिए वह बगैर विधायक बने अधिकतम आगामी 11 सितम्बर 2024 अर्थात 6 महीने तक मुख्यमंत्री के पद पर रह सकते हैं।
भारत देश के संविधान के अनुच्छेद 164(4) का हवाला देते हुए हेमंत ने बताया कि उसमें स्पष्ट उल्लेख है कि कोई मंत्री (मुख्यमंत्री ) जो निरंतर 6 माह की किसी अवधि तक राज्य के विधान-मंडल का सदस्य नहीं है,उस अवधि की समाप्ति पर मंत्री नहीं रहेगा. उन्होंने आगे बताया कि चार माह पूर्व 3 नवंबर 2023 को मौजूदा 14वीं हरियाणा विधानसभा के कार्यकाल के चार साल पूरे हो गए थे।
4 नवंबर 2019 को प्रदेश की विधानसभा का पहला अधिवेशन ( सत्र) बुलाया गया था. संविधान के अनुच्छेद 172 के अनुसार प्रत्येक राज्य की प्रत्येक विधानसभा, यदि पहले ही विघटित (भंग) नहीं कर दी जाती है तो, अपने प्रथम सत्र के लिए नियत तिथि से पांच साल तक बनी रहेगी, इससे अधिक नहीं और पांच वर्ष की उक्त अवधि की समाप्ति के साथ ही वह विधानसभा भंग होगी।
बहरहाल, मौजूदा 14वीं हरियाणा विधानसभा का कार्यकाल इस वर्ष 3 नवंबर 2024 तक है, हालांकि इसे समय से पहले ही भंग किया जा सकता है. ऐसा करने के लिए मुख्यमंत्री की अध्यक्षता में प्रदेश कैबिनेट ( मंत्रिमंडल) निर्णय लेने के लिए सक्षम है जिस पर राज्यपाल की स्वीकृति से विधानसभा नियत 5 वर्ष की समय अवधि से पहले ही भंग हो जाती है।
हेमंत ने आगे बताया कि 3 नवंबर 2023 के बाद यानी वर्तमान 14 वीं हरियाणा विधानसभा के चार साल के कार्यकाल के पूरा होने के बाद, यदि कोई विधानसभा सीट किसी मौजूदा विधायक की निधन, त्यागपत्र या उसकी अयोग्यता के कारण खाली हो जाती है एवं रिक्त घोषित कर दी जाती है तो भारतीय चुनाव आयोग द्वारा उस रिक्त विधानसभा सीट पर कोई उपचुनाव नहीं कराया जा सकता है।
क्योंकि 3 नवंबर 2023 की तारीख से उस ऐसे पूर्ववर्ती विधायक का शेष बचा कार्यकाल एक वर्ष से कम समय का होगा एवं लोक प्रतिनिधित्व कानून, 1951 की धारा 151(ए) के अंतर्गत ऐसी रिक्त सीट पर चुनाव आयोग द्वारा उपचुनाव नहीं कराया जाता है जिस पर पूर्ववर्ती विधायक का शेष कार्यकाल एक वर्ष से कम होता है।
इसी बीच उपरोक्त का एक तोड़ बताते हुए हेमंत ने बताया कि अगर विधानसभा के कार्यकाल के अंतिम वर्ष की अवधि दौरान किसी ऐसे व्यक्ति को प्रदेश का मुख्यमंत्री या मंत्री नियुक्त किया जाता है, जैसे आज नायब सैनी को हरियाणा का मुख्यमंत्री बनाया गया है, जो मौजूदा हरियाणा विधानसभा के सदस्य नहीं है तो उस परिस्थिति में विधिवत रूप से रिक्त हुई किसी विधानसभा सीट पर चुनाव आयोग द्वारा उपचुनाव कराया जा सकता है।
हेमंत ने इस सम्बन्ध में वर्ष 1986 का उदाहरण दिया जब हरियाणा में मुख्यमंत्री बने बंसी लाल ने तत्कालीन हरियाणा विधानसभा की एक वर्ष से कम अवधि शेष होने बावजूद भिवानी जिले की तोशाम विधानसभा हलके से उपचुनाव जीता था. हेमंत ने बताया कि चूँकि आज की तारीख में हरियाणा प्रदेश की वर्तमान 14 वीं विधानसभा में कोई सीट रिक्त नहीं है।
इसलिए अगले 6 माह में तभी उपचुनाव कराया जा सकता है जबकि कोई मौजूदा विधायक सीट से त्यागपत्र दे जिसकी सम्भावना बहुत ही कम है. बहरहाल, ऐसी परिस्थिति में अर्थात अगले 6 माह अर्थात 11 सितम्बर 2024 से पूर्व नायब सिंह सैनी विधायक नहीं बन सकते हैं. तो उन्हें समय रहते मौजूदा 14 वी हरियाणा विधानसभा को निर्धारित समय से पूर्व अर्थात 3 नवम्बर 2024 से पहले भंग कराना होगा ताकि विधानसभा के अगले आम चुनाव कराए जा सकें।
