The State Administrative Council (SAC) which met under the chairmanship of Governor, Satya Pal Malik approved re-organization of the Jammu & Kashmir Forensic Science Laboratory (J&K FSL).SAC approved merging of the existing 4 divisions in FSL Jammu and FSL Srinagar. After the merger, the Narcotics, Chemistry and Toxicology divisions shall be named as Narcotics/Chemical divisions, the Biology, Serology and DNA division shall be named as Biology/Serology division, the Physics and Ballistic division shall be named as Physical division and the Cyber and Documents division as Technical Division. The DNA division shall be a part of Biology / Serology Division of FSL Srinagar.It is pertinent to mention that J&K FSL has two laboratories, one each at Srinagar and Jammu. At present, both the FSL Labs are handling 4100 cases per annum on an average. With the introduction of modern information technology tools, new patterns of crime have arisen thereby posing varied challenges to FSL experts. The FSL Labs, therefore, require new Forensic Divisions with experts in the relevant fields like voice identification, video authentication, DNA Profiling, Computer/Cyber Forensics etc.The reorganization of the FSL Lab with adequate manpower in the relevant expert field will esnure time bound investigations leading to speedy trials in courts of law. Besides, the dependence of the Investigating Agencies on the FSL Labs outside Jammu and Kashmir will be reduced to a large extent.
SAC approved creation of 88 additional posts of different categories. The posts include 2 posts of Deputy Directors, 8 posts of Scientific Officers, 12 posts of Assistant Scientific Officers, one post each of Administrative Officer, Private Secretary, Accounts Officer, Assistant Accounts Officer, Section Officer, Accounts Assistant and Head Assistant, 2 posts of Senior Assistant, 22 posts of Lab Technician, 3 posts of Junior Assistant, 4 posts of Lab Assistant, 22 posts of Lab Attendants, 5 posts of Orderly and one post of Chowkidar. The re-designation of existing four posts of Deputy Directors was also approved.SAC approved establishment of 22 District Mobile Forensic Units in each district including Leh & Kargil, each comprising one Lab Technician and one Lab Attendant.SAC approved creation of 66 posts including 22 posts each of Head Constable, Selection Grade Constable and Constable by corresponding reduction of the same number of posts from the Police establishment.SAC also approved abolition of the Lie Detection Division and 28 existing posts of various categories.With a view to addressing the long pending seniority dispute in the FSL, address stagnation at various levels and streamline the FSL cadres, SAC approved creation of 04 supernumerary posts of Scientific Officers from different dates, promotion of 15 Assistant Scientific Officers as Scientific Officers from 10.10.2012 and promotion of 08 Scientific Officers as Deputy Directors w.e.f. 11.06.2019.
SAC approves promotion/release of grade to 38 officers of various services
The State Administrative Council (SAC) which met under the chairmanship of Governor, Satya Pal Malik approved promotion/ release of grade to the officers of the Indian Police Service, Indian Forest Service, Jammu and Kashmir Administrative Service and other departmental services.SAC approved promotion of three IFS officers of 1987 batch, namely, Mr. Om Praksh Sharma, Dr. Mohit Gera (on proforma basis) and Mrs. Neelu Gera to the level of Principal Chief Conservator of Forests w.e.f. 01.08.2019; promotion of two IFS officers of 1993 batch, namely, Mr. Sanjay Kumar Sinha and Mr. R.K. Tiwari (on proforma basis), two IFS officers of 1994 batch, namely, Mr. Vasu Yadav and Mr. J. Frankoi to the level of Additional Principal Chief Conservator of Forests w.e.f. 01.01.2019.In another decision, SAC also approved ante-dating of promotion of one IFS officer of 1989 batch, namely, Mr. B.K. Singh (on proforma basis), one IFS officer of 1990 batch, namely Mr. Jigmet Takpa (on proforma basis) and one IFS officer of 1991 batch, namely, Mr. Suresh Kumar Gupta to the level of Additional Principal Chief Conservator of Forests from 09.02.2018 to 01.07.2017. SAC approved promotion of two IFS officers of 2001 batch, namely, Mr. P.K. Raghaw and Ms. Shally Ranjan to the level of Chief Conservator of Forests w.e.f. 01.01.2019.SAC accorded sanction to the ante-dating of promotion of seven IPS officers namely, Mr. S. Anand Jain and Mr. S.R. Samuel (on proforma basis), Mr. Nitish Kumar, Mr. Ashkoor Ahmed Wani from 05.06.2017 to 01.01.2017, Mr. Nissar Ahmad from 05.06.2007 to 01.03.2017 and Mr. Ghulam Hassan Bhat from 01.01.2018 01.04.2017. Further, promotion of Mr. Bashir Ahmad Itoo to the Super Time Scale (ii)-IGP w.e.f. 01.01.2017 has also been approved. SAC also approved placement of Mr. Amit Kumar, IPS in the Selection Grade of IPS (Level-13) in the pay matrix w.e.f. 01.01.2019.SAC approved release of Selection Grade (non-functional) in respect of one IFS officer of 2005 batch namely Dr. V.S. Senthil Kumar w.e.f. 01.01.2018 and three IFS officers of 2006 batch namely Dr. M.K. Kumar, Mr. Irfan Rasool Wani and Mr. S.Harmohinder Singh w.e.f. 01.01.2019.SAC approved release of Selection Grade of the Jammu and Kashmir Administrative Service in favour of Mr. Shahnawaz Bukhari w.e.f. 01.05.2014.SAC also approved appointment (by promotion) of seven officers of different departmental feeding services to the Time Scale of Jammu and Kashmir Administrative Service w.e.f. 01.01.2018. The officers are Mr. Mohammad Rashid (Excise and Taxation Service), Mr. Samir Ahmad Jan, Mr. Rishi Kumar Sharma and Manpreet Kour (Rural Development Service), Mr. Saleem Beigh, Ms. Dilshada Akhter and Mr. Rafiq Ahmad Lone (Social Welfare Service). SAC approved release of grade to the Time Scale of Jammu and Kashmir Administrative Service in favour of Mr. Vijay Shankar Lahori at Time Scale level (notional basis) w.e.f. 23.09.1997 to 09.08.2005 and Selection Grade of Jammu and Kashmir Administrative Service notionally w.e.f. 10.08.2005 to 30.06.2006 and regularly w.e.f. 01.07.2006 to 31.07.2006.In a significant decision, SAC also approved appointment of Dr. Sunanda Raina, Professor and Head, Department of Anatomy, Government Medical College, Jammu as Principal, Government Medical College, Jammu w.e.f. 13.03.2017.In another decision, SAC approved promotion of Mr. Iftikhar Ahmad Hakim as Chief Town Planner, Town Planning Organization w.e.f. 01.09.2016.SAC also approved regularization of promotion of Mr. Mohammad Ashraf Pandit and Mr. Skinder Mohan Kapoor, Joint Directors Prosecution as Directors Prosecution w.e.f. 14.08.2017 to 31.05.2019 and 15.03.2018 respectively. SAC approved promotion of Mr. Rakesh Kumar, Senior Private Secretary of the Jammu and Kashmir Private Secretaries to Head of Departments (Gazetted) Service as Principal Private Secretary w.e.f. 30.09.2019 in the Level-12 in the pay matrix.
SAC approves restructuring of PDD, JKSPDCL, JKSPTCL for implementation of Power sector reforms between UT of J&K and UT of Ladakh
The State Administrative Council (SAC) which met under the chairmanship of Governor, Satya Pal Malik accorded sanction to the unbundling of the Jammu and Kashmir Power Development Department (JKPDD), J&K State Power Development Corporation limited (JKSPDCL) and J&K State Power Trading Company Limited (JKSPTCL) (to be renamed as J&K State Power Trading Corporation Limited) .Consequent to the enactment of the Jammu and Kashmir Reorganization Act, 2019 and repeal of the Jammu and Kashmir Electricity Act, 2010, the Central Electricity Act-2019 will come into effect on 31.10.2019, necessitating the restructuring of JKPDD in terms of mandate, functions and jurisdiction between UT of J&K and UT of Ladakh.As per the SAC decision, all the shares held by Governor in JKSPDCL, JKSPTCL and Jammu and Kashmir State Power Transmission Company Limited (JKSPTCL) (to be renamed as Jammu and Kashmir State Power Transmission Corporation Limited) shall be transferred to the Administrative Secretary, JKPDD. The stamp duty payable, if any, shall be exempted. The JKSPDCL shall control the composition of the Board of Directors of the Companies including JKSPDCL, JKPTCL, Jammu Power Distribution Company Limited (JPDCL) (to be renamed as Jammu Power Distribution Corporation Limited) and Kashmir Power Distribution Company Limited (KPDCL) to be renamed as Kashmir Power Distribution Corporation Limited). In this regard suitable provisions shall be made in the Articles of Association (AoA) of four companies and MoA of JKSPDCL. The Corporations shall be headed by the Administrative Secretary, JKPDD, Union Territory (UT) of Jammu and Kashmir as Chairman and Director having representatives from other Departments and from Government of India, Ministry of Power. The Administrative Secretary, JKPDD will approve necessary changes in the MoA and AOA of these companies which shall be placed before the Board of Directors/shareholders of these Companies for approval.The staff of different wings of the JKPDD shall be deputed to the respective corporations and assets and liabilities of the Department shall also be handed over to the respective Corporations. The interest of serving employees of JKPDD, JKSPDCL and JKSPTCL shall be protected and not varied to their disadvantage in terms of service benefits. All the staff of JKPDD and JKSPDCL proposed for transfer to these successor companies and JKPDD, UT Ladakh shall be transferred on existing terms and conditions protecting their lien and their existing emoluments.The Management of all these companies shall frame their Recruitment rules and Delegation of Financial Powers and will be finalized by the JKPDD after the recommendations of the Board of Directors of these Companies. Till these successor corporations frame and adopt their own rules, the extant Government rules and regulations shall be applicable.Following the SAC approval, the functions, mandate, and jurisdiction of JKPDD will be divided between UT of J&K and UT of Ladakh. The functions of JKPDD comprising transmission, distribution and implementation of Centrally Sponsored Schemes will be unbundled into one Transco i.e J&K PTCL and two Disco company’s i.e JPDCL and KPDCL. The unbundling will also involve incorporation of a new company in Ladakh for handling generation and distribution functions i.e Ladakh Power Company Limited (LPCL).All the functions of generation, transmission, distribution and trading will be handled separately to make power sector in Jammu and Kashmir commercially viable and competitive central assistance in the form of Power Reforms Grant can be availed.SAC further directed that the proposal for regular promotions in the Engineering Cadre of the Power Development Department be processed for consideration of the Competent Authority in the Government, as a onetime exception. SAC further directed that the process be completed by 30.11.2019.
Career progression issues of officers of Jammu and Kashmir Legal Services, Law Officers Service resolved
SAC approves re-organization of two services
In a major decision aimed at equitable career progression of officers and addressing stagnation, the State Administrative Council (SAC) which met under the chairmanship of Governor, Satya Pal Malik approved the reorganization of the Jammu and Kashmir Legal (Gazetted) Service and Law Officers Service. This will end up adhocism, which had stunted career progression of officers in the two services thereby, leading to de-motivation and disillusionment among the officers. The decision will not only ensure regular promotions at various levels upto 31.12.2018 but also help in better cadre management.The Jammu and Kashmir Legal (Gazetted) Service and Law Officers Service shall now be two distinct cadres and will operate separately with a separate seniority.SAC further approved that the Jammu and Kashmir Legal (Gazetted) Service shall be primary and progressive service. The Law Officers Service will be a diminishing service/cadre which shall cease to exist with the retirement or death or relinquishment of post by the last incumbent beginning from the Public Law Officers. The abolition of the posts which will begin from the level of Public Law Officers will finally culminate at Special Secretary level. In future, all fresh recruitments to the entry level posts shall be made in the Jammu and Kashmir Legal (Gazetted) Service only.SAC approved the promotion/release of grade of Secretary to the Government in favor of three Special Secretaries.SAC approved the promotion of 4 Additional Secretaries as Special Secretaries, 23 Deputy Legal Remembrancer/Senior Law Officers as Additional Secretaries, 54 Assistant Legal Remembrancer/Public Law Officers as Deputy Legal Remembrancer/Senior Law Officers and 36 Legal Assistants as Assistant Legal Remembrancer/Public Law Officers.SAC also approved creation of one post of Secretary to Government, 02 posts of Special Secretaries, 03 posts of Additional Secretary, 08 posts of Deputy Legal Remembrancer, 10 posts of Assistant Legal Remembrancer besides creating 02 posts of Deputy Director (Adm) and 04 posts of Assistant Director (Adm) in the Department of Law, Justice and Parliamentary Affairs.
