Gill Commission Submits 7th Interim Report On False Cases, Recommends Cancellation Of 21 FIRs

Justice (Retd.) Mehtab Singh Gill Commission on Wednesday submitted to Chief Minister Captain Amarinder Singh its 7th Interim report on politically motivated, false cases registered during the erstwhile SAD-BJP regime.The report recommends cancellation of 21 FIRs filed maliciously, while dismissing 158 frivolous complaints out of the total of 179 cases examined in this round. Of the total 4213 complaints received by it, the Commission has so far dealt with 1074, of which 746 have been dismissed, while action has been recommended on 328 complaints.Besides cancellation of FIRs in 21 cases, the Commission, in its 7th interim report, has also recommended disciplinary action against the erring police officers/officials, including registration of FIR against certain police officials u/Section 58 of the ND & PS Act and Sections 193 and 195 of the Indian Penal Code. The Commission has also recommended award of adequate monetary compensation to the accused (complainants before the Commission) to be recovered from certain police officials, and initiation of proceedings U/S 182 IPC against author of the FIR and against certain prosecution witnesses.

The dismissals relate to cases of challans being put up in the Courts, trials going on in the Courts, or there being no political vendetta, or the complaint is of such a nature which is not concerned with the Commission, according to an official spokesperson.In order to fast-track the implementation of the various recommendations made so far by the Commission, the government has already appointed District Magistrates and District Attorneys as Nodal officers, said the spokesperson. The State Home Department has also issued detailed instructions to the Director Prosecution and Litigation, as well as to all the District Magistrates, SSPs, and District Attorneys, across the State in this regard. The nodal officers have been directed to ensure strict compliance in line with the recommendations of Commission within three weeks, and submit their reports to the Commission directly under intimation to the Home Department.The spokesperson disclosed that district-wise progress reports had so far been received from 15 nodal officers. These reports show that in 69 cases, proceedings under section 182 IPC have been initiated and are pending in the Courts, while compensation has already been awarded in 24 cases.The district wise cases include 13 from Ludhiana, Taran Tarn (12), Ferozpur (11), Patiala (7), Gurdaspur (6), Faridkot (5), Sri Muktsar Sahib (5), Amritsar (4), Kapurthala (3), Shaheed Bhagat Singh Nagar (2), and Fatehgarh Sahib one case.
