Traffic Department has issued directions to the personnel deployed in the field to enforce laws related to the four-wheelers (Cars and Light Motor Vehicles) and deal with the violators strictly.In a communication issued by the Traffic Department today, it has been directed that  any person driving a  four-wheeler  found using mobile phone should be booked u/s 184 of  M.V.Act, 1988, besides his driving license should be seized and sent to the concerned RTO for suspension for not less than three months. It has also been directed that if the driver or the person occupying the front seat of a four-wheeler (LMV) does not wear seat belt, both the driver and the person occupying the front seat should be subjected to Road Safety Education and Counseling for not less than two hours before imposing fine under the relevant provisions of the M.V.Act, 1988.

Traffic Department has issued directions to implement laws related to requirement of driving license for driving a four-wheeler. If any person is driving a four-wheeler without having a valid driving license, the driver shall not be allowed to drive the vehicle further. The vehicle should be handed over only to a person, having a valid driving license and duly authorized by the owner, failing which the vehicle shall be seized u/s 207 of the Motor Vehicles Act, 1988.  The driver of the four-wheeler driving the vehicle without having an valid driving license to drive the vehicle (LMV) shall be booked u/s 181 of the M.V.Act, 1988 which not only provides for imposition of fine but also imprisonment for a term which may extend up to three months. Also, if a person having a learner’s license is found driving the four-wheeler (LMV) without being accompanied by a person, who is not having an valid driving license, he should be booked u/s 181 of the M. V.Act, 1988.

It is pertinent to mention that the Supreme Court Committee on Road Safety has recently given directions regarding suspension of the driving licenses for a period not less than three months of those using mobile phone while driving a vehicle. The Committee has further directed that those who violate the seat belt law should be subjected to Road Safety Education and Counseling for not less than two hours before imposition of fine as prescribed under the Act.
