Postponement of Examination: Court permits students to file writ petition

A Division Bench of Jammu Kashmir High Court on Thursday while declining to entertain a PIL on the postponement of Class 10 and 12 examinations permitted the students to file a writ petition in this regard. The Division Bench comprising Chief Justice Vasanta Kumar and Justice Ali Muhammad Magray PIL filed through Students Association can’t be entertained on the grounds that it doesn’t represent all the student community.Pertinently, Jammu Kashmir Students Welfare Association had approached the High Court through a PIL seeking postponement of class 10 and 12 exams till March 2017. The Association had pleaded that government be ordered to take steps for completing syllabus of students. The students body had also sought directions to complete practical work in the classes before conducting examinations.The PIL was approved and listed for hearing on Thursday; however, the Division Bench maintained that Association through which PIL has been filed may not represent the whole students community. “There may be students who wish to appear in the examinations. It is better you withdraw the PIL and students are permitted to file a writ petition and appear in their personal capacity,” the Division Bench maintained.Advocate Shafqat Nazir told news agency CNS that they have withdrawn the PIL and the court has permitted them to file a writ petition through students and not through any Association.
