Masrat Aalam’s aide’s detention under 2nd PSA challenged

The High Court Tuesday issued notice to police and District administration Bandipora for filing objections in two weeks in a case challenging the detention of Masrat Aalam’s aide Assadullah Parrey under Public Safety Act.Muslim League district president Bandipora Assadullah Parrey, a resident of Syed Mohalla Hajin who is presently lodged in Udhampur Jail under Public Safety Act was arrested by police from his residence on 14 August 2014 for his alleged involvement in anti-India activities. Subsequently, the District Magistrate Bandipora slapped PSA (DMB/PSA/04/2015) on Parrey and detained him in Udhampur Jail.A writ petition was filed by Parrey’s family through their counsel Bashir Ahmed Tak for quashing the detention under PSA and shifting the detainee from Udhampur Jail to Srinagar Central Jail. The Court quashed the PSA of Parrey on 29 December 2015, but he was rearrested and once again PSA (07/DMB/PSA/2016) was slapped on him on the same grounds.

His counsel informed the court of Justice Muzafar Athar that the order of detention issued against Assadullah Parrey has neither been approved by the government nor the matter has been referred to the Advisory Board within the time allowed by law.” He said that it is illegal to book an individual twice on the same grounds.Counsel Bashir Ahmed Tak according to CNS said the grounds of detention are vague and ambiguous, adding the detaining authority had termed the activities of the detainee highly prejudicial to maintenance of security of the state.While listening to the submission made by counsels from both sides Court directed the state to file objections within 2 weeks against the quashing of detention of Asadullah Parrey under Public Safety Act.
