Aam Aadmi Party (AAP) on Wednesday levelled serious charge against Narendra Modi led government at the centre accusing it of shielding congress leader and prime accused in the 1984 anti Sikh massacre, Jagdish Tytler.Senior Supreme Court Lawyer and member AAP, HS Phoolka along with Sangrur MP Bhagwant Mann said Union Minister for Food processing industries Harsimrat Kaur Badal has no right to continue as during the tenure of Modi government too the CBI once again has attempted to protect Jagdish Tytler by not filing the status report in the Karkardooma  court in Delhi on February 2. Phoolka said this  was the third time that the CBI had attempted to give a clean chit to Jagdish Tytler. Earlier, on two occasions the Court had rejected the clean chit by the CBI and directed investigation. 

Phoolka said the CBI with a view to save Jagdish Tytler on February 2 (yesterday) discreetly and surreptitiously filed this Closure Report in the Court and did not even inform the victim or the media of the same.According Phoolka he got this information from a source and appeared in the Court and argued the matter and got this Closure Report rejected. Phoolka said the order of the Judge SPS Laler , ACMM of the Karkardooma  court on December 4 last year clearly show that the earlier clean chits were wrongly given to Tytler. Infuriated by this illegal action of the CBI, the Court had directed that it would monitor the investigation. The Court directed the CBI to submit the Status Report on the progress of investigation against Jagdish Tytler on February 2, 2016.

However yesterday (Tuesday) the CBI neither filed the Status Report nor was any officer present before the Court to inform about the progress in investigation. Phoolka argued before the Court that CBI was continuing in its attempt to shield Jagdish Tytler and today’s conduct of CBI showed that they have no respect for the Court and its orders.The Court took a serious note of this and directed SP of CBI to appear in the Court on February 22,the next date of hearing, for an explanation. Phoolka said It appeared that CBI did not file the Status Report intentionally as the investigating agency wanted to avoid the present Judge who had rejected their clean chit and passed a very strong order against the CBI on December 4 last year.Now the Judge S.P.S Laler, ACMM, Karkardooma, is being transfered and is likely to handover the charge next week. It appears that CBI intentionally did not appear before this Judge as they want to avoid him. These kinds of manipulations were seen during the Congress regime. Now even the Modi Government has also started doing the same to save culprits, said Phoolka. 

Mann said the BJP as well as Akali Dal who have been taking votes on the issue of punishing the guilty of 1984 Genocide, are now hand in glove in shielding the culprits in the same way as the  Congress did. Harsimrat Kaur Badal, when in the opposition raised the issue of clean chit to Jagdish Tytler in the Parliament many times, now is comfortably enjoying her Ministership, while her Government continues to shield Jagdish Tytler. Harsimrat Kaur Badal has no right to continue as a minister and she should resign, added Mann.
