Delhi HC helps Muslim girl live with Hindu husband

Coming to the aid of a Muslim girl who alleged threats from her family members after she married a Hindu, the Delhi High Court has allowed them to live together.Justice Sanjeev Khanna and Justice Ashutosh Kumar, holding that girl has completed 18 years and wanted to live with her husband the court asked her parents not to interfere.The order came on a habeas corpus plea of the girl's husband Akash, 21, who alleged that his wife's parents were against their marriage and apprehended they might get her married to someone else."We have spoken to the girl and she has stated that she would like to go and live with Akash, who is her husband," the bench said.When the case came up for hearing in December 2014, the girl told the court that she had gone willingly with Akash from Delhi to Noida and had returned home of her own will. Admitting that she was married to Akash, the girl said that she was never detained by Akash against her wishes.

The girl had also stated that she has not decided her further course of action, wished to reside with her parents and expressed a desired not to lead a married life for next three years.Taking into note her statement, the bench in December had ordered that the girl could remain with her parents and stay with them in Delhi. The parents weredirected not to get her married and the police was directed to ensure compliance.However, in January Akash filed an application before the bench saying his wife had informed him on telephone that she was taken to Meerut in Uttar Pradesh and he apprehended that she was being married to another person.The court then asked police to ascertain the girl's whereabouts. After the police could not find her, the bench summoned the girl as well as her father to ascertain the facts.Appearing before the court, she said that she was beaten by her family members, who wanted her to get her married to another person and expressed her desire to live a married life with her husband.Disposing of the plea, the bench held that as girl is over 18 years of age and willing to live with her husband, it was allowing them to live together.
