Crime Branch Kashmir Friday presented charge sheet of case against accused persons namely Muhamamd Shafi Bhat, Gulzar Ahmad Bhat, Mohammad Yousuf Bhat of Kanihama, Chadoura, Budgam before the court of Chief Judicial Magistrate Budgam. The instant case was registered at Crime Branch Kashmir subsequent to an order passed by the hon’ble court of Chief Judicial Magistrate Budgam in complaint titled Bashir Ahmad Bhat V/S Muhammad Shafi and others. It was inter-alia alleged that the accused persons have resorted to manipulation/fabrication of documents and have thereby deceitfully and fraudulently obtained thumb impression of father of the complainant on the pretext of installation of a poultry farm but instead of installation of the poultry farm secured a court decree in respect of land of which the father of the complainant was having ownership rights.
The investigation conducted has revealed that one Ghulam Muhamamd Bhat was having ownership rights over 13 kanals and 10 marlas of land situated at Kanihama Chadoura. The accused persons named above under well designed conspiracy motivated the said Ghulam Muhamamd Bhat for installation of a poultry form and induced him to put his thumb impression on a plane paper under the belief that these papers are being utilized to raise a loan for installation of a poultry form it was fond that the accused persons with malafied intentions fabricated these documents/papers and after resorting to impersonation secured a court decree in respect of land measuring 13 kanal 10 marlas.During the course of investigation it was also found that thumb impression obtained deceitfully by the accused persons has been dishonestly and deceitfully used in securing the court decree as confirmed by the opinion of the handwriting expert.
During investigation it has also surfaced that the court decree obtained by the accused persons on the basis of manipulated documents has been declared null and void by the competent court of jurisdiction.On the strength of cogent and clinching oral and documentary evidence coupled with opinion of forensic handwriting expert, the investigation has substantiated that the accused persons in furtherance of a well knit criminal conspiracy have deceitfully obtained the thumb impression of father of the complainant and have subsequently taken undue advantage of it by obtaining a court decree in their favour to transfer land measuring 13 kanals and 10 marlas situated at Kanihama, Chadoura from ownership rights of father of the complainant as such were found to have committed offences punishable U/S 420, 468,471, 209, &120-B RPC.
