The High Court Friday issued notices to police and District administration Pulwama and Baramulla directing them to file objections within two week’s time in twin cases related to Public Safety Act under which two persons including an 18 year old student have been booked and lodged in Kathua jail.In the Court of Justice Ali Muhammad Magray, the counsel for 18 year old arrested student Advocate Bashir Ahmed Tak submitted that Irfan Ahmed Bhat son of Abdul Aziz, a resident of Kelan Gundmosa Pulwama was framed in false cases by police vide FIR number 11/2016 under section 147,148,149,332,427 of RPC. “Irfan was picked up by police party from Kakapora from his residence on 26 January 2016 and PSA was slapped on him on 24 February 2016. My client is a class 12th student and he is not involved in any kind of stone-pelting. The police have arrested him on mere suspicion,” Advocate Tak submitted and appealed court that PSA slapped on Irfan should be quashed and he should be released without any delay.The court was satisfied with the arguments of the Counsel and directed District Police and administration to submit objections within two weeks time.
In another similar case, Justice B.L.Bhat asked Baramulla district administration to keep all records available in the court with regard to the arrest subsequent detention of Palhalan youth Nasir Ahmed Ganaie under Public Safety Act. Advocate Bashir Ahmed Tak, the Counsel for Nasir Ahmed Ganaie submitted before the court that all the charges leveled against his client are frivolous while the fact is that he has already been bailed out by court and yet PSA was slapped on him. “My client has been arrested 31 January 2014 and the irony is that police have charged him for the alleged role in stone-pelting in the year 2010. What was police doing and why it waited for 4 long years? Police have also accused him of being the part of group that pelted stones on a police vehicle in October 2013 in Palhalan and for that charge he had already been bailed out by the court,” Advocate Bashir Ahmed Tak submitted.After listening the arguments from both the sides, Justice BL Bhat sought objections from the police within two week’s time.
